Petit Larceny in Long Island

In New York, stealing or theft offenses are referred to as larceny. Larceny can be committed in several different ways, through concealed means or fraud. This may include theft by extortion, bad checks, false promise, embezzlement, or robbery/burglary. The nature of the specific charges against a person accused of larceny will depend on the type and value of property taken, and from whom and where it was taken.

There are two main categories of theft: petit larceny and grand larceny. Petit larceny, or petty theft, is the simplest, least severe form of theft. It occurs when an individual takes another person’s property without their knowledge or consent. This type of larceny typically involves shoplifting or some other non-violent form of theft of property that is valued at no more than $1,000. Classified as a Class A misdemeanor, petit larceny is punishable by a maximum fine of $1,000 and up to one year in jail.

Grand Larceny Charges

Grand larceny, or grand theft, is a felony theft crime. It involves the unlawful taking of someone else’s property that is valued at more than $1,000. It can also result from theft of property that occurs in particular circumstances. There are four degrees or levels of grand larceny in New York. The degree of a specific grand larceny offense will depend on the value of the property and other factors.

The four classifications of grand larceny include:

  • Grand larceny in the fourth degree – Theft of property that exceeds a value of $1,000 is a Class E felony, punishable by up to four years in prison and a maximum fine of $5,000.

  • Grand larceny in the third degree – Theft of property that exceeds a value of $3,000 is a Class D felony, punishable by up to seven years in prison and a maximum fine of $5,000, or twice the amount of the property stolen, whichever is greater.

  • Grand larceny in the second degree – Theft of property that exceeds a value of $50,000 is a Class C felony, punishable by up to 15 years in prison and a maximum fine of $15,000.

  • Grand larceny in the first degree – Theft of property that exceeds $1,000,000 is a Class B felony, punishable by up to 25 years in prison and a maximum fine of $30,000.
