Long Island Robbery/Burglary Defense Lawyers

Many people use the words burglary and robbery interchangeably. In New York, however, these two terms refer to two distinct crimes. Burglary involves entering into a building with an intent to commit a crime – whether an assault, theft, or any other type of offense – even if the intended crime did not occur.

For example, if an individual is invited over to someone else’s home, and then remains on the premises unlawfully while intending to commit a crime, burglary charges can result.

Understanding Robbery Charges

“I was robbed,” is a common phrase people use when someone has taken something from them without their consent. Technically, this phrase is only used correctly by those victims who had a face-to-face encounter with their perpetrator. Robbery involves the use of force against a victim, or instilling fear in a victim, before, amid, or following the commissioning of a property crime. The severity of the crime increases when the defendant displays or uses a weapon, or the action results in the physical injury to the victim.

The Penalties for Robbery & Burglary

Both burglary and robbery are prosecuted as felonies and can result in severe consequences. Sentencing is dependent on the nature of the crime, what type of harm was suffered by the victim, and a variety of other factors. Defendants can also face enhanced penalties when they have prior felony convictions.

The classification and penalties of burglary and robbery crimes include:

  • Robbery in the third degree – Class D felony punishable by two to seven years in prison

  • Robbery in the second degree - Class C felony punishable by seven to 15 years in prison

  • Robbery in the first degree - Class B felony punishable by 10 to 25 years in prison

  • Burglary in the third degree – Class D felony punishable by one to seven years in prison and a maximum fine of $5,000

  • Burglary in the second degree – Class C felony punishable by one to 15 years in prison and a maximum fine of $5,000

  • Burglary in the first degree – Class B felony punishable by one to 25 years in prison and a maximum fine of $5,000
